The role of an equity receiver (non-rents & profits receiver) in a business takeover can substantially speed up recovery to a secured creditor by having the court appointing order allow the receiver to serve as “New Management” of a distressed company, whose primary responsibility is to marshal, manage and maintain the status quo of a business or asset until the primary subject of the lawsuit is resolved. A receiver will often need the help and assistance of a forensic accountant / auditor to review and analyze the company’s assets, books, and records, thus allowing for a quick and deep investigation of the debtor’s financial affairs. This information can then be shared with secured creditor and other stakeholders to help determine the best way to proceed. This program will discuss real-world examples and mechanics of proceeding in this manner.
